Welcome to DevOps Agent! By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using DevOps Agent ("the Service"), you agree to comply with and be legally bound by these Terms of Service, whether or not you become a registered user. If you do not agree to these Terms, you must not use the Service.

These Terms constitute a binding legal agreement between you and DevOps Agent. Your use of the Service constitutes your acceptance of these Terms.

2. Service Description

DevOps Agent provides an AI-powered platform that enables users to:

Manage cloud infrastructure (AWS, Azure, GCP)
Execute commands on remote servers and cloud resources
Automate DevOps workflows
Interact with Kubernetes clusters
Perform infrastructure monitoring and management

The Service utilizes artificial intelligence models (including Claude by Anthropic) to interpret natural language commands and execute infrastructure operations.

3. User Responsibilities

You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Be solely responsible for all activity under your account
Review all AI-generated commands before execution
Maintain backups of critical data and infrastructure
Ensure you have proper authorization to access cloud resources
Comply with all applicable laws and regulations
Not use the Service for any illegal or unauthorized purpose

4. Prohibited Activities

You shall NOT:

Use the Service to harm, disrupt, or gain unauthorized access to any system
Attempt to reverse engineer, decompile, or hack the Service
Share your account credentials with unauthorized parties
Use the Service to violate any laws, regulations, or third-party rights
Transmit viruses, malware, or malicious code
Use the Service to send spam or unsolicited communications
Bypass rate limiting or security measures
Resell or redistribute the Service without authorization

5. Limitation of Liability

⚠️ CRITICAL LEGAL PROTECTIONS

5.1 NO LIABILITY FOR DAMAGES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVOPS AGENT SHALL NOT BE LIABLE FOR ANY:

Loss of profits, revenue, or business opportunities
Loss of data, data corruption, or data breaches
Cost of substitute goods or services
Business interruption or downtime
Server failures, crashes, or infrastructure damage
Cloud infrastructure costs or unexpected charges
Damages caused by AI-generated commands or actions
Security breaches or unauthorized access
ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

This applies regardless of whether we were advised of the possibility of such damages.

5.2 "AS IS" AND "AS AVAILABLE" SERVICE

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose
Non-infringement of third-party rights
Accuracy, reliability, or availability of the Service
Uninterrupted or error-free operation

YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.

5.3 MAXIMUM LIABILITY CAP

In no event shall DevOps Agent's total aggregate liability to you for all claims arising from or related to the Service exceed ONE HUNDRED DOLLARS ($100 USD), or the amount you paid for the Service in the twelve (12) months preceding the claim, whichever is LESS.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether or not we were advised of the possibility of such damages.

6. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS DevOps Agent, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

Your use or misuse of the Service
Your violation of these Terms
Commands or actions executed on your behalf by the Service
Damage to your cloud infrastructure or resources
Unauthorized access to your accounts due to your security failures
Your violation of any laws or regulations
Your violation of any third-party rights
Any claims made by third parties related to your use of the Service

THIS MEANS: If someone sues us because of your actions, YOU will pay all our legal costs, damages, and expenses.

7. No Warranty

We make NO WARRANTIES regarding:

The accuracy of AI-generated commands or suggestions
The reliability or uptime of the Service
The security of your data or cloud credentials
Compatibility with your infrastructure or systems
The results or outcomes of using the Service

YOU ACKNOWLEDGE that AI models may make errors, and you are solely responsible for reviewing and approving all actions before execution.

8. Data and Security

While we implement industry-standard security measures, we CANNOT and DO NOT guarantee:

Absolute security of your data or credentials
Prevention of all unauthorized access or data breaches
Recovery of lost or corrupted data

You are responsible for:

Maintaining secure passwords and credentials
Regularly backing up your data
Monitoring your cloud infrastructure for unauthorized access
Implementing your own security measures

9. Cloud Provider Costs

YOU ARE SOLELY RESPONSIBLE FOR:

All charges incurred with your cloud providers (AWS, Azure, GCP, etc.)
Monitoring and managing your cloud spending
Preventing runaway costs or unexpected charges
Setting up billing alerts and cost controls

DevOps Agent is NOT liable for any cloud infrastructure costs, charges, or expenses incurred through your use of the Service.

10. Termination

We reserve the right to:

Suspend or terminate your account at any time, for any reason, without notice
Refuse service to anyone at our sole discretion
Modify or discontinue the Service without liability

Upon termination, you remain liable for all obligations incurred prior to termination.

11. Dispute Resolution

⚠️ ARBITRATION AND NO DAMAGES CLAUSE

11.1 BINDING ARBITRATION

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), rather than in court.

You WAIVE your right to a jury trial and to participate in class actions.

11.2 CLASS ACTION WAIVER

YOU AGREE that any arbitration or legal proceeding shall be conducted on an INDIVIDUAL basis only, and NOT as a class action, consolidated action, or representative action.

You WAIVE your right to participate in any class action lawsuit or class-wide arbitration.

11.3 NO DAMAGES TO PLAINTIFF

⚠️ CRITICAL: In the event of ANY claim, dispute, or lawsuit, regardless of outcome, YOU ACKNOWLEDGE AND AGREE that you are entitled to:

❌ NO MONETARY DAMAGES
❌ NO COMPENSATION
❌ NO PAYMENT

From DevOps Agent beyond the actual amount paid for the Service (limited to $100 USD MAXIMUM).

This means: EVEN IF YOU SUE AND WIN, your recovery is limited to $100 USD or less. You will NOT be awarded damages for losses, harm, or expenses beyond this amount.

11.4 LEGAL FEES

Each party shall bear its own attorney fees and costs in any dispute. You will NOT be entitled to recover attorney fees, even if you prevail in arbitration or litigation.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. You consent to the exclusive jurisdiction of courts located in the United States for any disputes.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and DevOps Agent regarding the Service and supersede all prior agreements, understandings, and communications.

📢 IMPORTANT ACKNOWLEDGMENT

BY USING DEVOPS AGENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS, INCLUDING:

✅ "AS IS" service with no warranties
✅ Your obligation to indemnify us for all claims
✅ Waiver of class actions and jury trials

✅ Your sole responsibility for all cloud costs and damages
✅ Binding arbitration for all disputes
